This is the official website for the U.S. ASR Hip Settlement Program (the “Settlement Program”), which is a voluntary program arising from two Settlement Agreements between DePuy Orthopaedics, Inc. and a Court-appointed committee of plaintiffs’ lawyers (the “Parties”). The first Settlement Agreement, dated November 13, 2013 (“2013 Settlement”), compensated eligible ASR patients in the United States who had surgery to replace their ASR™ XL Acetabular Hip System or ASR™ Hip Resurfacing System, known as revision surgery, before August 31, 2013. The second Settlement Agreement, dated March 2, 2015 (“2015 Settlement”), originally compensated eligible ASR patients in the United States who had surgery to replace their ASR™ XL Acetabular Hip System or ASR™ Hip Resurfacing System, known as revision surgery, between August 31, 2013 and January 31, 2015. On March 3, 2017, the Parties approved the 2017 ASR Extension Agreement (“2017 Extension Agreement”) to modify and amend certain provisions of the 2015 Settlement. The 2015 Settlement now compensates eligible ASR patients in the United States who had surgery to replace their ASR™ XL Acetabular Hip System or ASR™ Hip Resurfacing System, known as revision surgery, through February 15, 2017. All references on this website to the 2015 Settlement include, by reference, the 2017 Extension Agreement. The deadline to enroll in the 2015 Settlement is December 1, 2017. The deadline to submit a Green Claim Form for Past Matrix Level benefits from the EIF Award Program is December 1, 2017. The deadline to submit a Green Claim Form for Future Matrix Level benefits is within 90 days of the respective claim’s accrual.

This website contains important information about the Settlement Program. Any capitalized term not defined in any text or document appearing on this website shall have the meaning ascribed to it in the Settlement Agreement. If there is a conflict between anything on this website and the Settlement Agreement, the Settlement Agreement controls. The Parties prepared a summary document Materials Required for Enrollment that provides a checklist of required Enrollment documents and forms. Click the applicable hyperlink to review a copy of that document.

We have created a News and Developments menu button on the left that will provide claimants and law firms with new information about the Settlement Program and the claims process. All claimants and counsel should check the News and Developments section often for updates. The Summary from the Settlement Oversight Committee (“SOC”) on Settlement Benefits provides a high-level summary of the benefits available to eligible claimants who qualify under the terms of the Settlement Agreement.

The SOC created a Damages Calculator to help claimants and law firms determine the amount a Product User may receive for his or her Part A Base Award. Click on the News and Developments menu button to access the Damages Calculator, which is intended to be used only as a hypothetical tool. The Claims Processor will not reference or use the Damages Calculator when determining a Product User’s Part A Base Award.

All claimants and counsel for represented claimants should check this website frequently for updates to the Settlement Program. If you already have access to the ASR Portal, you can register a new Product User by using the Register New Product User button in your Registration Tab. If you are a law firm or pro se Product User that does not have access to the ASR Portal, please contact the Claims Processor at claimsprocessor@USASRHipSettlement.com or (877) 391-3169. The Claims Processor will provide you with a Registration spreadsheet or Pro Se Registration Affidavit. Registering does not obligate you or your client to choose to enroll, as there are later deadlines for enrollment. This website will change as the Settlement Program evolves and will serve as the central place for you to obtain and submit official forms and documents for use in the claims process.

Questions by health insurers regarding a settlement recipient's medical costs that are directly associated with a revision surgery should be directed to ASRRecall-US@its.jnj.com.

The menu buttons at the left contain important documents and information about how to contact the Claims Processor. We will add to these menu buttons and increase the functionality of the existing buttons as the process unfolds.
